A man has been sentenced to 12 years in prison for the fatal assault of his elderly neighbor following a dispute about an open gate.

Trevor Gocan, aged 57, assaulted 74-year-old James “Jim” O’Neill on October 6, 2024, outside their residential complex in Covent Garden, central London, resulting in a traumatic brain injury for Mr. O’Neill.

He succumbed to his injuries in the hospital two weeks later.

On May 1, Gocan was found guilty of manslaughter by a jury and is required to serve two-thirds of his sentence in prison before being eligible for parole.

During the court proceedings at Southwark Crown Court, it was revealed that the confrontation began when Gocan left a gate ajar in the estate.

CCTV footage captured the incident, which lasted under 90 seconds, ending with Mr. O’Neill lying on the ground with severe injuries.

Judge Sally-Ann Hales KC remarked to Gocan: “You had no need to feel threatened; in reality, you lost your temper and your composure.”

“Clad in shorts and Crocs, he posed no significant danger to you. If you had truly felt at risk, you had the option to walk away.”

The judge further noted that the nature of Gocan’s assault, which involved one punch and two kicks, posed a “high risk” of causing serious injury or death.

In a victim impact statement, Mr. O’Neill’s widow, Sara, shared her profound grief, admitting she has been plagued by nightmares.

“Jim was not only my husband of 49 years but my true soulmate,” she said. “I struggle with insomnia and often find myself reliving the horrific sight of my beloved bleeding on the floor.”

Mrs. O’Neill mentioned that she had decided to sell their home and felt unable to leave the apartment for weeks after the tragic event.

In a letter presented in court, Gocan expressed his remorse for the violent incident.

“I let down my children, my faith, myself, and above all, Mr. O’Neill,” he stated.

Judge Hales responded, “I am convinced that Mr. O’Neill’s death resulted from an unlawful act falling just short of grievous bodily harm.

“You claimed to have called emergency services, yet your phone showed no evidence of such a call. The reality is that you did absolutely nothing.”

Wearing grey prison-issue sweats, Gocan displayed no visible reaction as his sentence was announced.
